Bullied Special-Ed student taken to court (48)

A Mentally Challenged student who was frequently bullied by his fellow classmates, decided to record with his ipad one of his harassments.

He had previously asked the school before for prevention in these matters but denied it. After the recording reached back to the principle of school, thanks to the victim's mother, he proceeded to call the police and took the victim to court under the charge of wiretapping.

The judge found the victim guilty under the charge, meaning the victim's act in trying to give proof of the bullying's done to him was wrong.

There is definitely something else going on here.
There's no way there is a reasonable expectation of privacy in a classroom or school.
There's also clearly a reason for the recording, as proven by many previously reported incidents.
I don't think this is the full story.

Someone who is mentally or physically crippled, and bullying them, is a very low blow. Usually because they can't retaliate. As for the wiretapping, I don't think he should be out in court for that. So many other kids take selfies in their classrooms. Why aren't they in court too?
I hate the public school system. It's so pathetic and it disgusts me. All the teachers do is go off about nonsense, and usually they don't go deep enough that the students who actually pay attention don't get it. And the cases of bullying. Teachers don't intervene and don't even try to give a piece of crap. And those who do? Get fired or sued.

And I do agree that what happened with that was totally blown out of proportions and that really the bullies should be taken to court instead of the other kid. While technically he did do something illegal (though the whole privacy thing is complete BS), the bullies also did illegal acts by assaulting a mentally handicapped person and choosing to torment him both in and out of school. Hopefully they are able to change the situation for the better and find a way to repay the principal and the bullies back with interest.

A lot of kids get bullied cuz they act like retards.

But in this case, the kid IS retarded (to a certain extent) and from what we know, no, the kid didn't do nothing wrong, his only crime was showing proof of his innocence.

And we shouldn't be talking about the bullying itself, we should be talking about the ignorance among the judge, the principal, the teacher and the peers.

And yes, I am disappointed with the human race because we have become so ignorant.

Updating on this piece of news. After some uproar by the fellow student body along with this news making national news, the case was taken back to court and the student was found innocent. Though no word has been said on the principle or the bullies, so for now one can assume nothing is happening to them.

But it is to note the morality of the bullies. Whether they are orphaned, raised by bad parents, or gave into peer pressure, it is still something to look at. For my personal opinion to those who seek such trouble and to cause pain, no matter their circumstances, their is only one word that can rectify the situation even in the bit of least: Punishment. Which is something at the moment which seems to be not happening to them.

Most wiretapping laws in U.S. allow for recording as long as one party knows. So I can record you without you knowing, or you can record me without me knowing, but the FBI can't record us with neither of us knowing without jumping through a lot of legal requirements that make us probable terrorists first. From a legal perspective I think that the problem is that he was on Govt. property and recording multiple people, some of whom were not involved. I could be completely wrong though.
